Terms and Conditions

We set out below the Terms and Conditions (“Terms”) that shall apply to you visiting the Norwich Ice Rink (including any purchase of tickets to the Ice Rink), taking place at Castle Mall Gardens (“Gardens”) between 15 December 2017 and 7 January 2018 inclusive (the “Event”) and including any purchase of tickets to the Ice Rink.  Please note that by entering the Event and/or purchasing any Tickets, you agree to be bound by these Terms. Furthermore, please note that entry to the Event and the purchase of any Tickets is also subject to the regulations of the Castle Mall Gardens (the “Gardens”).  The Event is being hosted by Archant Community Media Limited publisher of the Eastern Daily Press and Norwich Evening News (“us/we/our”).

The Terms are as follows:

  1. Participating in ice skating carries an inherent risk, any participation is totally at the users own risk. If you, or anyone under your supervision, has any medical conditions, serious previous injuries, recently broken bones, knee or joint problems, head injuries, pregnancy, mobility problems, or taking prescribed drugs you should carefully consider whether it is safe to participate without endangering yourself or anyone under your supervision or other participants whilst skating. You agree that you are responsible for your own safety and the safety of any children under the age of 12 that you are supervising.
  2. Entry to the Gardens is free; however you must produce or purchase a valid Ticket to gain entry to the Ice Rink. Other attractions at the Event may attract other charges.
  3. All Ticket sales are final. No refunds, cancellations or exchanges are available after you have purchased your Tickets. We shall not be liable for consequential losses, including but not limited to travel and car parking.
  4. It is your responsibility to check your Tickets and to ascertain the date and the time of your access to Ice Rink. You should arrive at least 15 minutes before the start time as stated on the Tickets.
  5. The duration of an Ice Rink session is 45 minutes. If you arrive late for your booked session you will not receive a full 45 minutes and your session will expire at the allocated time. No refunds will be given for late arrival which results in you not receiving a full skating session.
  6. We are not responsible or liable for any Tickets that are damaged, lost or stolen.
  7. Children under 4 will not be permitted on the Ice Rink (however will be able to come into the Gardens) and no child aged 12 or under will be admitted to the Ice Rink unless they are accompanied by a person aged 16 years or over (“Supervisor”) and such child or children whilst in the Gardens must remain under the control or supervision of the Supervisor at all times. The must be minimum of one Supervisor supervising a maximum of two children under the age of 12. All permitted children and Supervisors accessing the Ice Rink must have a valid ticket.
  8. Children under 12 must be supervised at all times whilst at the Event.
  9. Anyone using the Ice Rink must comply with the rules on display at all times, unless directed by a Marshall to do otherwise. We reserve the right to remove any skater not abiding by the rules.
  10. Alcohol is not permitted to be taken into the Gardens and we reserve the right to confiscate any alcohol. Use of illegal substances is prohibited.
  11. The Ice Rink will operate in all weather conditions. However in the unlikely event that we deem it necessary to close the Ice Rink or restrict access to the Gardens, we reserve the right at our discretion to offer either a refund or alternative sessions for skating, subject to availability.
  12. If we have to clear the Ice Rink for any reason, no refund/alternative session will be given if you have been on the ice for over 30 minutes.
  13. Please bring suitable outdoor clothing, the Event is an outdoor event and, subject to nine above, no refunds will be given due to inclement weather.
  14. Your purchase of Tickets is subject to our right without prior notice and without refund or compensation to close or change the programme of rides and attractions and/or the Event’s operating hours. We in our absolute discretion reserve the right at any time without refund or compensation to close any part of the Event or restrict the number of persons having access to the Event due to capacity, inclement weather, or special events to ensure safety, security or order, or if we consider the circumstances so require.
  15. If you leave the Ice Rink for any reason you will not be able to re-enter and no refund will be given.
  16. All rides, attractions, amusements, and other facilities must be used in accordance with the operator’s instructions.
  17. We accept no responsibility for any loss or damage however arising. Use of the Ice Rink and attendance in the Gardens is entirely at your own risk. Furthermore, we are not responsible for any injuries to visitors, however caused, save where any death or injury is caused by the proven negligence of us, our staff or our servants or otherwise cannot be excluded by law.
  18. Unless prohibited from limiting our liability by law, neither we nor any other party shall have any liability to you beyond the face value of the Ticket.
  19. There will be limited locker space available on a first come first served for you to store your belongings whilst on the ice. The lockers are limited in size to approximately the size of a medium handbag.  There is a non-refundable £1 charge for the use of lockers.  All other belongings must be stored safely out of the way of walk ways.  Where we, in our reasonable opinion, deem that belongings are not safely stored we reserve the right to remove such belongings from the Ice Rink.
  20. Storage facilities at the Ice Rink are limited, and we reserve the right to refuse admission if, in our reasonable opinion, you try to bring bulky items into the Ice Rink area.
  21. Neither we nor the Gardens can accept any responsibility for personal property, so please take care of your belongings. Any items left at the Event or that are put in lockers at the event are left entirely at your own risk.
  22. If the Event and/or any attractions are cancelled in its entirety, we will use our reasonable endeavours to notify you as soon as possible (including notifying you of the details of any re-scheduled dates and operating hours the Event and/or attraction will be open). If you have already purchased a ticket for a cancelled attraction, we reserve the right, at our discretion, to offer either a refund or reschedule your booking to an alternative date/time (subject to availability). Tickets cannot be exchanged or refunded after purchase other than in accordance with this clause. We shall not be liable for consequential losses, including but not limited to travel and car parking. Refunds or any other type of compensation will not be available for disruption to or cancellation of the Event or any ride or attraction within the Event resulting from events beyond our, or the operators of the relevant attractions, control
  23. In order to facilitate the security, safety and comfort of all patrons, we and the Gardens reserve the right in our/their reasonable discretion to conduct security searches of persons, clothing, bags and all other items on entry and exit, to confiscate items which may cause danger or disruption to the Event or other patrons or are in breach of these Terms and/or to refuse admission. Where we refuse admission under this clause you will not be entitled to any refund on your ticket/s.
  24. You may be ejected from the Event and the Park if, in our or the Gardens reasonable opinion, you are a risk to the safety of any patron and/or may affect the enjoyment of other patrons and/or the running of the Event or may cause damage, nuisance or injury. Examples include being (or appearing to be) drunk, incapable, intoxicated or under the influence of illegal drugs, under-age (where relevant), abusive, threatening, behaving anti-socially, carrying offensive weapons or illegal substances, declining to be searched or in breach of any of these Terms or the terms and conditions of the Gardens.
  25. CCTV and cameras (including TV) may be present at the event. By purchasing a Ticket to the Event and/or attending Gardens you give your express consent to all such filming and to your actual or simulated likeness being included within any film, photograph, audio and/or audiovisual recording (“Footage”), all rights in which will be owned by us. You also agree that any such Footage may be used by us in any and all media for any purpose at any time throughout the world, including (with the exception of CCTV or security Footage) for commercial purposes.
  26. Photography and filming on site is only allowed for personal use. Commercial or editorial photography is prohibited without prior written permission from us.
  27. In the case of any problems at the Event contact a steward immediately, as it may not be possible to resolve issues after the Event.
  28. In the event of an emergency, visitors must follow instructions and directions from stewards, staff and/or other officials.
  29. The Event and attractions are subject to obtaining the relevant licences.
  30. We reserve the right to change these Terms and Conditions from time to time. Your continued use of this website and attendance to the Event after changes are posted means you agree to be legally bound by these Terms as updated and/or amended. It is your responsibility to check the Terms before entering the Event, so that you are aware of any changes.
  31. If any provision of these Terms is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms valid and enforceable.
  32. These Terms shall be governed by English Law and we both agree to subject to the exclusive jurisdiction of the English courts.
